1. Scope of FixaTrader Services

Throughout these Terms, "Poster" refers to a customer or user posting a job request, and "Fixer" refers to a tradesperson responding to or completing a job.

• FixaTrader provides the Platform to enable Posters to publish Posted Jobs.
• Fixers may make a Quote in response to a Posted Job. Some parts of Quote details may be made publicly available, including to internet users who are not Users.
• A Poster may revoke or modify a Posted Job at any time before they accept a Quote. FixaTrader reserves the right to cancel all Quotes made prior to the modification.
• If a Poster accepts a Quote, the Posted Job is assigned to that Fixer. At this point, a Job Contract is created between the Fixer and the Poster.
• When creating a Job Contract, the Poster must deposit the agreed price into the secure Payment Account.
• After the Job Contract is created, both parties can modify it through the FixaTrader Platform. We recommend using FixaTrader's private messaging system for all job-related communication or changes.
• Once the Job Contract is completed, both parties are encouraged to leave reviews and feedback through the Platform.

2. Use of the Platform

• You must be at least 18 years old to use FixaTrader.
• You agree to use the Platform only for lawful purposes and not to provide false or misleading information.
• Businesses may “claim” their profile to verify ownership and update their information.
• You agree not to misuse the Platform, including by uploading malicious content, harassing other users, or attempting to bypass security measures.

3. Fees & Payments

FixaTrader Ltd does not charge users any connection, quoting, or payout fees. All payments between customers and tradespeople are securely processed through Stripe. Any applicable Stripe payment or processing fees are the only charges applied.

Payments are held securely until both parties confirm the job has been completed, at which point funds are automatically released to the Fixer’s connected Stripe account.

We never handle or store card details directly. Payment security and compliance are managed by Stripe in accordance with PCI DSS standards.

Payment Disputes: If a payment dispute arises between a customer and tradesperson, resolution is handled through Stripe's dispute process in accordance with their terms. FixaTrader does not arbitrate disputes or issue refunds on behalf of either party but may provide relevant transaction information to assist in resolution where appropriate.

4. Public Profiles & Information

Some business listings on FixaTrader may include publicly available information sourced from Companies House, official directories, or other open data sources. This information helps ensure profiles are discoverable and accurate.

Profile Verification: When businesses claim their profile, we may verify ownership through document checks, phone or email confirmation, and review of publicly available business data. Verified profiles are marked accordingly on the Platform.

5. Disclaimer & Liability

The Platform is provided “as is” and “as available,” without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We aim to ensure information on the Platform is accurate, but we do not guarantee completeness or suitability. FixaTrader Ltd is not responsible for any losses, damages, or disputes arising between customers and tradespeople.

Limitation of Liability: To the extent permitted by law, FixaTrader Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

• Your use or inability to use the Platform;
• Any unauthorized access to or use of our servers;
• Any interruption or cessation of service;
• Any conduct or content of third parties;
• The quality or outcome of work performed by tradespeople found through the Platform.

We do not guarantee that the Platform will always be available, uninterrupted, secure, or error-free. We may suspend or withdraw access at any time for maintenance, updates, or legal compliance.

6. Account Suspension or Removal

We may suspend or remove accounts or listings that breach these Terms, provide false information, or misuse the Platform.

• Providing false, misleading, or fraudulent information;
• Harassment or abusive behavior toward users;
• Posting false or defamatory reviews;
• Impersonating another person or business;
• Engaging in fraudulent activity or payment disputes;
• Violating any applicable laws or regulations;
• Using the Platform in a way that harms others or FixaTrader.

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion if necessary to protect our users, our business, or comply with legal obligations.

7. Reviews & User Content

Users may submit reviews, ratings, comments, photos, and other content ("User Content") through the Platform. By submitting content, you grant FixaTrader a non-exclusive, worldwide, royalty-free license to use, display, and distribute it in connection with the Platform.

• Your content is accurate and based on genuine experience;
• It does not violate third-party rights (including intellectual property or privacy);
• It is not defamatory, obscene, or unlawful;
• It does not contain harmful code or links.

FixaTrader reserves the right to moderate, edit, remove, or refuse User Content that violates these Terms or is deemed inappropriate. We are not responsible for any User Content posted by others and do not endorse opinions contained within it.

8. Intellectual Property

All site content, branding, logos, and design elements remain the property of FixaTrader Ltd or our licensors. You may not reproduce, distribute, modify, or create derivative works without prior written consent.

9. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website. Continued use of the Platform after updates constitutes your acceptance of the revised Terms. For significant changes, we may notify you via email or a notice on the Platform.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
